Westward Marketing Privacy Policy
1. Who we are and what this covers
We are WESTWARD MARKETING LLC, a Montana limited liability company. In this policy, "we", "us", and "our" mean that company. "You" means the person reading it.
This policy covers two things:
- Our website at westwardmarketing.ai, including every page we run there.
- Our Services, which are the website and marketing services we sell on a monthly subscription. Your order or checkout page describes what your plan includes.
Section 5 covers a separate topic: the information about your own customers that we handle when you hire us.
You can reach us at lyman@westwardmarketing.ai, 1239 Harvard Avenue, Billings, MT 59102, or (406) 861-8546.
2. What we collect
Form and intake submissions. When you fill out a contact form or our onboarding intake form, we collect what you type. That usually includes your name, business name, email address, phone number, service area, and details about the work you do. The intake form also collects photos of your work, brand assets such as a logo, and domain or registrar access details.
Booking data. When you book a call with us, we collect your name, your contact details, the time you picked, and any notes you add.
Account data. Once you are a client, we keep records tied to your account. That includes your billing contact, your plan, your subscription status, your support messages, and notes about the work we did for you.
Analytics. When you visit our website, we collect basic usage information such as the pages you viewed, the general area suggested by your IP address, your browser and device type, and the site that sent you to us. Some of this comes from cookies and similar tools.
Payment information. Stripe handles our payments. When you pay us, your card details go to Stripe. We never store your full card number. We see only limited billing records such as the last four digits, the card brand, and whether a payment went through.
Call recordings. We may record sales calls and testimonials for quality and training purposes. We tell you when a call is being recorded, and a testimonial is never published without your permission.
3. How we use it
We use the information above to:
- Set up, build, and run the Services you bought.
- Deliver leads to you, including calls and form fills we pass along by text.
- Answer your questions and give you support.
- Bill you, collect payment, and keep our accounting records.
- Send you service messages about your account, your site, and your billing.
- Send you marketing messages when you have agreed to receive them.
- Improve our website and our Services.
- Meet our legal, tax, and record keeping duties.
We do not sell your personal information. Section 8 says more about that.
4. SMS and text messaging
How you opt in. You opt in to text messages from us by giving us your mobile number and agreeing to receive texts. You can do that on a form on our website, on our intake form, in writing, or by texting us first. We tell you what the messages are for at the point where you opt in. Agreeing to marketing texts is never a condition of buying anything from us.
What we send. Once you opt in, we may text you about your account, your project, appointment reminders, replies to your questions, and offers or updates that you agreed to receive.
Message frequency varies.
Message and data rates may apply. Your mobile carrier sets those rates.
How to stop. Reply STOP to any of our text messages to opt out. We send one confirmation message and then stop texting you. Reply HELP for help, and we reply with our contact details. You can also email lyman@westwardmarketing.ai to opt out.
Our commitment on sharing. SMS opt-in consent and phone numbers collected for SMS purposes are not shared with third parties or affiliates for marketing purposes.
Our text messaging runs on a carrier registered program known as A2P 10DLC. Carriers review and approve that registration before any messages go out.
5. Your customers' data when you are our client
When you hire us, we handle information about your customers. That includes the leads who call you or fill out your forms, and any contact list you bring with you.
Here is how that works:
- You own the customer relationship. Your customer data belongs to you. We do not use it for our own marketing, and we never sell it.
- We act as a service provider. We process your customer data on your behalf and follow your instructions. In privacy law terms, you are the controller and we are the processor.
- Consent is yours to gather and honor. You are responsible for making sure your customers agreed to be contacted, and for honoring their opt outs. We build and run the tools that send the messages. The permission behind those messages comes from you.
- You can take it with you. If you cancel, you can export your customer data. The export window is 60 days after your cancellation takes effect.
If one of your customers contacts us about their data, we point them to you and help you respond.
6. Who we share with
We share information with companies that help us run the business. Each one gets only what it needs to do its job. The categories are:
- Platform and messaging infrastructure, for the software that runs your website and your records, and for the calls and texts that carry your leads. For example, our marketing platform provider and the phone carriers.
- Payment processing, for billing and receipts. For example, Stripe.
- Hosting, for keeping websites and data online.
- Analytics, for understanding how our website gets used.
SMS opt-in consent and phone numbers collected for SMS purposes are not shared with third parties or affiliates for marketing purposes.
We may also share information when the law requires it, such as a valid legal request, or when we need to protect our rights or someone's safety. If our business is ever sold or merged, information may transfer as part of that deal, and this policy keeps applying until we tell you otherwise.
7. Retention and deletion
We keep account data while your account is active. After you cancel, we keep what we need for our records, our taxes, and our legal duties, and we delete or archive the rest.
You can ask us to delete your information at any time. Email lyman@westwardmarketing.ai and we delete what we can. Some records have to stay, such as invoices and payment records the law requires us to keep, and anything we need to settle an open dispute. We tell you if we keep something and why.
Your customer data follows section 5. You can export it during the window listed there. After that window closes, we may delete it.
8. Your choices and rights
You can ask us to:
- Show you the personal information we hold about you.
- Correct information that is wrong or out of date.
- Delete your personal information, subject to the limits in section 7.
- Stop marketing messages. Reply STOP to a text, click unsubscribe in an email, or email us.
Email lyman@westwardmarketing.ai to make a request. We confirm who you are before we act, so that nobody else can make a request in your name. We respond within the time the law allows.
We do not sell personal information. We also do not share it for cross context behavioral advertising. If that ever changes, we will update this policy and give you a clear way to opt out first.
Depending on where you live, you may have added rights under state or national privacy laws. We honor those rights when they apply to you.
9. Children
Our website and our Services are built for businesses and the adults who run them. They are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child gave us information, email lyman@westwardmarketing.ai and we will delete it.
10. Changes to this policy
We may update this policy as our Services change or as the law changes. When we do, we update the "Last updated" date at the bottom. If a change is significant, we tell you by email or through your account before it takes effect.
